Skills Assessment
A skills assessment application is a process that evaluates an individual's qualifications and work experience to determine if they have the necessary skills to work in a specific occupation or profession in Australia. Skills assessment is a requirement for certain visas only.
There are many skills assessing authorities that conduct such applications, it will depend upon the nominated occupation. Each assessing authority has their own criteria for assessing an individual's skills and qualifications, which may include academic transcripts, employment references, and language proficiency test results.
If the individual is deemed to have the necessary skills and qualifications, they will be issued with a positive skills assessment, which they can then use as part of their visa application.
It's important to note that the requirements and processes for skills assessment can vary depending on the occupation and the assessing authority, so it's essential to carefully research and follow the relevant guidelines to ensure a successful application.
Merits Review
It is an application to review the original decision made under the Migration Act 1958 and determine whether it was a correct or preferable decision. The Administrative Appeals Tribunal (βAATβ) has the jurisdiction to review decisions related to migration and refugee visas and visa-related decisions.
The AAT is independent from the Department of Home Affairs and will make its own decision. It has the power to: -
affirm a decision;
vary a decision;
set aside a decision and substitute a new decision; or
remit a decision to the decision-maker for reconsideration.
Not all decisions are reviewable and the decision letter from the Department of Home Affairs will advise if you can apply for merits review. There is a specific timeframe to make such application with the AAT. Your application will be deemed invalid if you fail to meet the deadline.
